RE: FRAUD REPORT – Wake County Judge Kristin Ruth abuse of SIP Funds
I write to report abuse of federal funds that your office provided to Wake County Court Judge Kristin Ruth.
In 2008, Ruth was awarded a Special Improvement Grant (SIP) from the Office of Child Support Enforcment (OCSE) for problem solving. Instead of solving problems in the Wake County Court system, Ruth added to them by using a fake/unlawful court form that enabled hundreds of misdemeanor court cases to be unlawfully continued for a year and longer in the Wake County District Court, which violates state and federal laws and Constitutions.
Per NCGS§15A-606, the only pre-trial motion allowed in district court is a probable cause hearing, which is supposed to occur within 15 business days of a defendant’s first appearance in court. The fake court form, signed by Ruth is enclosed. As a district court judge, Ruth should understand lawful district court procedure. Additionally, all lawful court forms contain an “AOC” code in the lower left corner. Anyone using reasonable diligence as required by Title 42 of U.S. Code knows the difference between real and fake court forms.
Judge Kristin Ruth committed a felony, obstruction of justice in the Wake County Court for signing an unlawful/fake court document. The enclosed court document unlawfully and unconstitutionally keeps defendants accused of misdemeanors trapped in the Wake County court for a year or longer, which is in violation of numerous state statutes and the U.S. and North Carolina constitutions, including 26 USC §7206, which states:
Any Person who… (1) Declaration under penalties of perjury – Willfully makes and subscribes any return, statement, or other document, which contains or is verified by a written declaration that is made under the penalties of perjury, and which he does not believe to be true and correct as to every material matter; shall be guilty of a felony and, upon conviction thereof;
- Shall be imprisoned not more than 3 years
- Or fined not more than $250,000 for individuals ($500,000 for corporations)
- Or both, together with cost of prosecution
Judge Kristin Ruth has yet to acknowledge that she has caused a fundamental obstruction of justice for a class of people so enormous that they may never all be identified, let alone provided relief.
Ruth continues to act as a judge under color of law in the Wake County Court and claimed immunity for her felony by filing a motion to dismiss it in U.S. District Court. Judge Kristin Ruth has abused the trust placed in her, and must repay the federal government for the funds that she received and grossly abused acting under color of law.
Additionally, an organization called North Carolina Fathers has reviewed Judge Ruth’s website and found that Ruth is not enforcing equal parental access to children, equal parenting rights and demonstrates clear bias against fathers in the North Carolina court system. I am including information from NC Fathers’ website.
I am copying the IRS on this letter so that they can impose a lien on Ruth’s property until she repays the SIP Funds to your office.
